District 49's packet for the August 13, 2026 regular meeting asked
the Board to accept and sign a five-year renewal contract with Pioneer
Technology and Arts Academy (PTAA). The contract is dated August 4, states an
effective period from July 1, 2026, through June 30, 2031, and contains
blank signature lines in the public packet. It is a proposed instrument, not an
inspected adopted or executed contract.
The cover says negotiations occurred by email among district counsel, the
superintendent, the charter-relations coordinator, PTAA counsel, PTAA's CEO,
its board president, and its principal. It characterizes the renewal as having
minimal conditions: training for new PTAA board members and continued use of
the district student-information system.
The proposed contract would establish a five-year authorizer relationship,
subject district financial commitments to annual appropriation, and allocate
specific oversight, reporting, data, waiver, enrollment, service, and funding
responsibilities. Several mechanisms depend on incorporated attachments:
7 is supposed to set compliance submissions and CDE collection8 is supposed to govern enrollment procedures for students with9 is cited for purchased services, per-pupil deductions,10 is cited for contracting limits. The packet next presents a special-education MOU labeled ATTACHMENT 9. It
allocates mild-to-moderate services primarily to PTAA and severe-need and
site-based services to District 49; provides for categorical funding subject to
described deductions; and makes the MOU separately effective upon execution.
The public packet does not display the contract's enumerated Attachments 1
through 8 or 10 within the PTAA item. The special-education MOU may be the
intended purchased-services Attachment 9, because the contract expressly
uses that number for both special-education obligations and purchased-service
deductions. The packet does not establish whether the displayed document is
the complete operative attachment set.
More decisively, the MOU repeatedly assigns fee amounts and its program model
to its own nested Attachment 1. Its cost section says the initial special-
education cost calculation is included there, but the displayed final page
contains only Attachment 1 [to be added]. The contract also retains the
template placeholder [Charter School Acronym] in its direct-cost
reconciliation clause.
These are direct packet-completeness observations. They do not establish that
the parties lack completed schedules elsewhere, that no costs have been
calculated, that the contract is invalid, that the Board cannot act, or that
any payment, withholding, legal violation, or harm has occurred.

The September 10 agenda lists PTAA waiver approval as consent item 6.7. An agenda item does not establish the vote or supply the complete executed renewal and attachments. The later agenda therefore does not resolve the packet-completeness questions below.
