In Colorado, a Board of Cooperative Educational Services is a statutory regional education-service unit formed by participating members to provide contracted educational, administrative, support, facility, community, or related services.

A BOCES is not the same thing as a school district. It is a cooperative public education structure created by participating members. It may serve school districts and, in some cases, postsecondary institutions.
A BOCES is also not the Colorado Charter School Institute. CSI is a separate statewide charter authorizer. A BOCES may have school-operating or contracting authority under BOCES statutes and member agreements, but that does not make every BOCES school arrangement equivalent to a CSI-authorized charter school.
A contract-school or provider arrangement is a practice or mechanism that may operate through a BOCES; it is not the definition of a BOCES itself. The legal status of any particular contract-school arrangement requires the actual agreement, statutory basis, CDE treatment, and relevant district consent record.
The clearest judicial limit in the current corpus comes from the 2024 Colorado Supreme Court decision in ERBOCES v. Colorado Springs School District 11. The court held that section 22-5-111(2) bars a BOCES from locating a school inside a nonmember district without that district's consent.
This limit matters for school-location and authorizing disputes. It does not prove that all BOCES-operated schools or programs are unlawful, nor does it settle other questions about contract schools, online schools, homeschool-enrichment programs, or financial oversight.
Official records in this pass show that CDE carries BOCES organization profiles through its SchoolView / financial-transparency systems, although individual profile access is uneven in the retained source layer. The 9160 Front Range BOCES follow-up currently preserves a CDE 404 response for the financial-profile endpoint, and the 9140 Blue Sky / Mt Evans follow-up shows a stale-name or name-transition issue rather than a clean current CDE profile label.
ERBOCES' own financial-transparency page cites Colorado school financial-transparency obligations and posts budgets, audits, check-register/card-statement pages, salary schedules, data-file pages, and related records.
The repo should not assume that all BOCES have identical tax-filing patterns, IRS Form 990 obligations, Secretary of State records, or posting practices. This continuation found ERBOCES in Colorado Secretary of State records as a Good Standing Colorado nonprofit corporation, found Colorado BOCES Association / Foundation ProPublica records as separate IRS-listed nonprofit entities, and returned ProPublica no-results for a selected priority subset of named BOCES. Official Colorado Open Data business-entity queries for that subset returned rows for ERBOCES and Colorado River BOCES, returned no visible business rows for Front Range, Blue Sky, Mt Evans, or Expeditionary, and returned no charities-registration rows for the six selected names. Those entity-specific findings and no-results do not establish a uniform tax posture for statutory BOCES.
In the same subset, official finance-page evidence is now strongest for Expeditionary / RMSEL and Colorado River. For public BOCES-specific finance claims, the stronger default source path remains CDE financial transparency, the BOCES' own budgets/audits/transparency postings, and the underlying statutory/member-agreement record.
